1. Definitions
This Agreement is governed by these Terms and Conditions. The following defined terms apply throughout this document:
Super Web Heroes (“The Company”)
Refers to Super Web Heroes, the service provider offering website design, maintenance, and support through subscription plans.
Client (“The Subscriber”)
Refers to the individual or business entity that purchases and actively holds an ongoing Subscription to any of The Company’s Plan tiers.
Subscription
Refers to the paid, non-exclusive agreement between The Company and The Subscriber for recurring access to defined Website Support Services.
Plan (Sidekick, Hero, Superhero)
Refers to the specific, tiered service package (e.g., Sidekick Plan, Hero Plan) selected by The Subscriber, detailing the scope of included Website Support Services.
Billing Cycle
Refers to the fixed, recurring period (typically 30 days) for which the Subscription is paid in advance.
Website Support Services
Refers to the work provided by The Company, which may include maintenance, security monitoring, technical fixes, design updates, and development tasks, as defined by the Plan tier.
Request
Refers to a specific, distinct task submitted by The Subscriber to The Company for execution under the terms of the active Plan.
2. Refund and Cancellation Policy
a. First-Month Refund Policy
If a client chooses to cancel their subscription during the first billing cycle:
- 100% Refund: A full refund will be processed only if the client cancels before Super Web Heroes has begun any work or executed any updates on the client’s website.
- 50% Refund: If the client cancels after Super Web Heroes has already made and delivered one or more updates to the client’s website, they will be eligible for a fifty percent (50%) refund.
b. Refund Policy After The First Month
If a client chooses to cancel their subscription after the first billing cycle, they will be eligible for a fifty percent (50%) refund, regardless of if Super Web Heroes has begun any work or executed any updates on the client’s website.
3. Subscription Pausing and Resumption
To maintain consistency and fairness, clients are allowed to pause their subscription only once per billing cycle.
- Pausing: When a pause is requested and approved, the current billing cycle will be frozen. No services will be delivered, and no days will be counted against the remainder of the cycle.
- Resumption: When the client requests to unpause the subscription, the billing cycle will immediately resume with the exact number of days remaining at the time of the pause.
- Limit Enforcement: If a client has already utilized the single pause allowance within the current billing cycle, any further pause requests will be denied until the next billing cycle begins.
4. Defining Scope and Fair Use Definition
Definition: A single subscription covers services for one (1) unique website domain only. The plan covers services explicitly listed in your chosen tier (Sidekick, Hero, or Superhero).
- Excluded Work: The subscription does not cover non-website tasks, such as graphic design for print media, video editing, social media management, email marketing campaign execution, or the creation of new software outside the existing CMS environment (e.g., custom mobile app development).
5. Request Submission and Sequencing
Definition: All work is executed on a task-by-task basis in the order they are received and approved, inless . Clients may submit multiple requests, but Super Web Heroes will only actively work on one (1) request at a time per dedicated designer/developer.
- Completion Requirement: A new request will not be started until the preceding request has been marked as complete and approved by the client. This ensures focused, high-quality, and timely delivery of each individual task.
- Request Clarity: Clients are required to limit each submission to a single, distinct task to ensure efficient completion (e.g., “Post Blog A” is one request; “Redesign Homepage and Footer” would be two distinct requests).
6. Ownership and Account Access
Definition: The client retains full intellectual property and ownership over all website files, data, content, and unique design work created under the active subscription.
- Access Provision: Clients must provide Super Web Heroes with necessary, secure administrator-level access (e.g., CMS login, hosting credentials) to perform the contracted maintenance and development services.
- Security Responsibility: The client agrees that Super Web Heroes is not responsible for any security breaches or data loss that occur after the client cancels their subscription or prior to the subscription’s start date.
7. Website Hosting Services
a. Hosting Inclusion and Cost
Super Web Heroes offers secure website hosting as an included benefit with every active Plan (Sidekick, Hero, and Superhero) at no additional cost to The Subscriber. Websites are hosted on servers maintained by Interactive Design Solutions. Use of this hosting is optional and is not mandatory for maintaining an active Subscription.
b. Hosting Transfer Process
Following the initiation of a Subscription, Super Web Heroes will contact The Subscriber via email to discuss the process for transferring the website to Interactive Design Solutions’ servers. The Subscriber is required to provide necessary credentials and administrative access to their current hosting account to facilitate a secure and complete transfer.
c. Continuation of Hosting Upon Cancellation
Should The Subscriber cancel their active Subscription, Super Web Heroes will continue to host the Subscriber’s website for an additional thirty (30) days from the final date of the last paid Billing Cycle.
This 30-day grace period is provided solely to allow The Subscriber sufficient time to organize and execute a transfer of their domain and website files to a new hosting provider.
Super Web Heroes bears no responsibility for any website functionality, security, or updates during this 30-day grace period.
After the 30-day grace period expires, Super Web Heroes reserves the right to remove the website files and domain configuration from its servers without further notice.
8. Communication About Your Subscription
We may send you transactional emails related to your subscription. You cannot opt out of these emails as they are necessary for managing your account. These may include:
- Payment confirmations
- Renewal notices
- Failed payment alerts
- Account changes
9. Changes to These Terms & Conditions
We may update these Terms & Conditions from time to time. We will post the new version on this page with the updated date.
